Who answers for your data

THE 5TH AVENUE REAL ESTATE L.L.C, trading as Avenue Properties, a real-estate brokerage based in Dubai, decides what this site and the investor portal collect and what is done with it. Its licence number, its RERA registration and its address are on the legal notice page.

For any question about this policy, or to exercise the rights set out below, the address to write to is at the bottom of this page.

What we collect

Nothing is gathered behind your back: it all comes from what you write to us, or from what an acquisition in progress requires.

• When you fill in a form — your name, your telephone number, your email address if you give one, the language of your enquiry, what you are looking for and your message, the reference of the property or project you were viewing, the page you wrote from and your consent, dated. A request for access to the club adds your budget and the kind of project you have in mind.
• When you become a client — what the next section, on the investor portal, describes.
• Technical data — your IP address is held in memory for a few minutes, long enough to stop automated form submissions; it is only recorded in the portal’s sign-in journal. We do no profiling and no targeted advertising.

The investor portal

Each client has a secure space to follow their investments. There is no open registration: the agency grants access, by invitation or through the member card given to the client, whose code works only once.

The portal holds:

• your identity and contact details — name, email, telephone and WhatsApp, language of correspondence;
• your properties — the project, the unit, its price, construction progress and the stages of the purchase (booking, SPA, Oqood, DLD registration, handover);
• your payment plan — instalments, amounts and recorded payments;
• the proofs of payment you declare, and the documents of your file: contracts, receipts, identity documents, deeds;
• your account’s security — when you signed in, the IP address and device used, failed attempts and, if you turn it on, two-step verification.

This information is used to keep your file, to remind you of your instalments and to let your advisor know when you add a payment or a document. It is never published or sold. You may ask to see it, correct it or delete it, within what our legal obligations require us to keep.

What we do with it

Each piece of information serves the reason you gave it to us:

• replying to you, calling you back, preparing a viewing, a valuation or an investment brief, introducing you to a partner if you ask;
• considering a request for access to the club;
• following your acquisition in the investor portal, and giving you access there to your payment plan and documents;
• sending you our market letter, if you asked for it;
• meeting the obligations of a real-estate broker in the United Arab Emirates, and protecting the site and the portal from fraudulent access.

On what grounds

In the United Arab Emirates our processing is governed by Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). If you live in the European Union, the General Data Protection Regulation (GDPR) also applies. We process your data:

• to take, at your request, the steps that come before a possible contract, when you write to us or ask for access to the club;
• to perform the contract between us, when you are a client and use the portal;
• with your consent, given by ticking the box under each form, and for the market letter — consent you may withdraw at any time;
• because the law requires it, for our professional and accounting obligations;
• because we have a legitimate interest in it, for the security of the site and the portal.

Who has access

Your data stays within the agency. It is accessed by:

• Avenue Properties advisors, to the extent their work requires;
• our technical providers, who act on our instructions and may do nothing else with it: the site’s host (Railway), the host of the database and documents (Supabase), the service that sends our emails (Resend);
• the developer concerned, the Dubai Land Department and the competent authorities, when a reservation or a legal obligation requires it;
• the partner you ask us to contact, and that partner only.

We never sell or rent your information to anyone.

Where it is kept

The database and the documents are hosted in Ireland, and the servers that run the site in the Netherlands, inside the European Union. Emails leave from servers in Ireland. Your data is consulted by our advisors from Dubai; those transfers are governed by the European Commission’s standard contractual clauses, agreed with our providers, and by the safeguards the PDPL provides.

For how long

• Enquiries that led nowhere, including club access requests not taken forward — three years from our last exchange.
• Client files and portal content — for as long as the relationship lasts, then five years, as our professional obligations require.
• Sign-in journal — twelve months.
• Member card codes — erased as soon as the card is activated or revoked.
• Market letter — until you unsubscribe.

Once those periods have passed, the data is deleted.

Your rights

You may at any time ask to see the data we hold about you, to have it corrected, erased or transferred, to restrict its use or to object to a use of it. Part of this information can be viewed and corrected directly in your portal. If you consented to our letter, that consent is withdrawn in one click from any of our emails.

Write to us at the address below: we reply within a month. If our answer does not satisfy you, you may refer the matter to the UAE Data Office and, if you live in France, to the Commission nationale de l’informatique et des libertés.

Cookies

This site shows no cookie banner, for a simple reason: it sets no analytics, advertising or social-media cookie.

• When you sign in to the investor portal, a session cookie keeps you signed in for your visit; it disappears when you sign out and serves no other purpose.
• If you close the “English version” banner, your browser remembers it locally; nothing is sent to us.

Should we ever add an analytics tool, we would ask for your consent before it runs.

How it is protected

Exchanges with the site are encrypted. Passwords are never stored in clear, only in a hashed form from which they cannot be recovered, and the portal offers two-step verification with an authenticator app. Sign-in attempts are limited and every sign-in is logged. In the database each client is walled off, and that rule is enforced by the server itself rather than by the site: a programming mistake therefore cannot expose someone else’s file. Documents are stored encrypted in a private space and open only through a signed link, valid for one minute. Access to the back office is reserved to the agency’s accounts.

If this policy changes

The date at the head of the page is the last revision. A change that altered how your data is used would be announced before it took effect.
